Terms of Service — Sarah Kammerer

Terms of service.

This agreement contains the entire understanding between Sarah K Photography and the CLIENT. It supersedes all prior and simultaneous agreements between the parties. The only way to add or change this agreement is to do so in writing, signed by all the parties. If the parties want to waive one provision of this agreement, that does not mean that any other provision is also waived. The party against whom a waiver is sought to be effective must have signed a waiver in writing.

Images and Copyright: Sarah K Photography retains the copyright to all images, per USC Title 17 (US Copyright Law) and may not be reproduced in any manner without Sarah K Photography's explicitly written permission. Upon final payment by CLIENT, the client will be granted a limited copyright license of the resulting images as outlined in agreement below.

LICENSe AGreement: The bearer of this notice (“Bearer”) has purchased high-resolution digital files from his/her photography session with Sarah K Photography (“SKP”). Bearer is hereby granted permission by SKP for any reasonable personal purposes, including but not limited to: printing, copying, emailing, and web publishing. This permission applies worldwide.

SKP and Bearer agree to the following additional terms:

1.SKP retains all copyright and moral rights to each image. SKP also retains all rights not expressly granted in this agreement, including its right to use images for promotional and advertising purposes unless stated otherwise in writing, including portfolio, web site, display, advertisement, and editorial use.

2.Bearer’s license to reproduce, distribute or publicly display these works does not include the ability to license the images to third parties.

3. This is non-transferable.

4. Bearer agrees that altering images without obtaining written permission from SKP is prohibited.

5. Bearer agrees that any public use of the images must bear a credit line, when possible, following this format © YEAR Sarah Kammerer or tagging @sarahck13.

PAYMENT SCHEDULE. CLIENT will be invoiced at booking. No images or products will be delivered until final balance has been paid.

CANCELLATION POLICY. Once an image has been delivered, there are no refunds or cancellations. You authorize SKP to charge you for the selection of image(s) and accept the terms stated within this License Agreement upon ordering the image(s).

LIABILITY Your purchase of the original files releases SKP from any liability due to loss or damage of the images, and also releases SKP from any obligation to maintain copies of any digital file, image, or photograph.

AGREEMENT AND PRICING. This AGREEMENT protects the CLIENT and legally binds SKP to deliver all of the following products and services in the time frame specified. Any breach of this agreement on the part of SKP will be subject to issuing a refund to the CLIENT.

By using any of the images provided, Bearer agrees to the above terms.
